The combined sales tax rate on restaurant sales in New York City is 8.875%. That total breaks down into three parts: 4% New York State sales tax, 4.5% New York City local tax, and a 0.375% Metropolitan Commuter Transportation District surcharge. Every restaurant, bar, cafe, food truck, and catering operation in all five boroughs charges this same rate on prepared food and beverages.
“Prepared food” is the key phrase. Grocery items sold in their original packaging are generally exempt from NYC sales tax, but the moment food is prepared, heated, or sold ready to eat, it becomes taxable at 8.875%. This includes dine-in meals, takeout, delivery orders, coffee drinks, alcoholic beverages, and anything from a steam table or buffet. If you run a restaurant or bar, essentially everything you sell to customers is taxable.
You collect the tax from customers and remit it to the New York State Department of Tax and Finance. When you register for a Certificate of Authority (which you must have before making any taxable sale), the DTF assigns you a filing frequency based on your expected sales volume. High-volume restaurants typically file monthly. Smaller operations may file quarterly. Very low-volume businesses might file annually. Whatever frequency you’re assigned, the returns and payments are due by the 20th of the month following the reporting period.
One thing restaurant owners sometimes overlook is that sales tax collected is not your money. It belongs to the state. Spending collected sales tax to cover operating expenses and then scrambling to pay it back at filing time is one of the fastest ways to create a financial hole. The penalties for late filing or underpayment add up quickly, and the DTF is not lenient about it.
